These Terms of Service ("Terms") govern the relationship between you ("User" or "you") and Frustm LLC ("Frustm," "we," "us," or "our") regarding your use of Frustm's games, websites, related services, and applications (collectively, the "Service" or "Games"). By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use the Service.
The Service is not directed to children under the age of 18. By accessing and using the Service, you represent that you are at least 18 years of age. If you are below 18, you confirm that your legal guardian has reviewed and agreed to these Terms.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of material changes by posting the updated Terms on our website, Frustm.com or Frustm.vercel.app, or within the Games. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
Subject to your agreement and continued compliance with these Terms, Frustm grants you a non-exclusive, non-transferable, revocable limited license to install and use the Service for your non-commercial entertainment purposes only.
The Service, including all games, titles, computer code, themes, objects, characters, names, stories, dialogue, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, operating methods, moral rights, documentation, and Frustm software (collectively, "Frustm Content") are owned by Frustm LLC or its licensors. All rights, title, and interest in and to the Service are owned by Frustm and are protected by international copyright and intellectual property laws.
You understand that while using the Service, you may "earn" or "purchase" virtual currency (e.g., gold, coins, diamonds) or virtual in-game items (collectively, "Virtual Items"). These Virtual Items are governed by these Terms and:
Virtual Items are licensed, not sold, to you.
Virtual Items have no monetary value and cannot be redeemed for cash, property, or other items of monetary value.
Your purchase of Virtual Items is a purchase of a limited, revocable license to use those Virtual Items within the Service. Virtual Items are forfeited if your account is terminated or suspended.
You may be required to create an account directly with Frustm or register through a third-party service (e.g., Google Play Games or Apple Game Center).
You are responsible for maintaining the confidentiality of your account details and for all purchases and activities occurring under your account. In the event that you suspect any unauthorized access or use of your account, you agree to notify Google immediately. Additionally, if the game provides online services, you agree to notify Frustm immediately of any suspected unauthorized access or use of your account.
Frustm reserves the right to suspend or terminate your account (and all associated licenses and Virtual Items) at any time for any reason, or no reason, without notice, including if we reasonably suspect that you have violated any provision of these Terms.
You agree not to do any of the following while using the Service:
Engage in any illegal, fraudulent, or abusive activities.
Use cheats, exploits, automation software, bots, hacks, mods, or any unauthorized third-party software designed to modify or interfere with the Service.
Disrupt, overburden, or aid in the disruption or overburdening of any computer or server used to offer or support the Service.
Attempt to gain unauthorized access to the Service, accounts registered to others, or the computer systems or networks connected to the Service.
Post or upload any user-generated content that is abusive, threatening, obscene, libelous, defamatory, or racially, sexually, religiously, or otherwise objectionable.
If the Service permits you to submit content (e.g., usernames, forum posts, chat messages), you grant Frustm a worldwide, irrevocable, perpetual, transferable, fully paid-up, royalty-free license, with the right to sublicense, to use, copy, modify, display, and distribute your User Content in connection with the operation of the Service.
All purchases of Virtual Items are transactions made through the relevant App Store (Apple App Store or Google Play Store) and are subject to the terms and conditions of that store. Frustm is not a party to the payment transaction.
Except as required by law or the terms of the applicable App Store, all purchases are final and non-refundable.
The Service may contain links to third-party websites or services. You acknowledge and agree that Frustm is not responsible or liable for any content, advertising, products, or materials on or available from such websites or services.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranty of any kind. Frustm expressly disclaims all warranties, whether express, implied, or statutory, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Frustm does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
To the maximum extent permitted by law, Frustm LLC shall not be liable for any indirect, incidental, special, exemplary, or consequential damages, including damages for loss of profits, goodwill, data, or other intangible losses, resulting from:
Your access to or use of or inability to access or use the Service.
Any unauthorized access to or use of our servers and/or any personal information stored therein.
Any conduct or content of any third party on the Service.
In no event shall Frustm's total liability to you for all damages exceed the amount you have paid to Frustm in the ninety (90) days immediately preceding the date on which you first assert any such claim.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
You and Frustm agree to resolve all disputes and claims between you and Frustm through binding arbitration, instead of in courts of general jurisdiction. The arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. This section does not preclude either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to preserve the status quo or prevent irreparable harm.
